1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of eastwoodhayden.com and its pages, forms, calculators, property-search tools, downloadable resources, chat, and related services (collectively, the "Site"). By using the Site, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Site.

2. License Holder and Brokerage Disclosure

This Site is operated for Hayden Eastwood, a Texas real estate sales agent, license number 848697. Hayden is sponsored by and provides brokerage services on behalf of JBGoodwin REALTORS®, Texas broker license number 401735. The sponsoring broker is responsible for brokerage activities performed by sponsored sales agents as provided by Texas law.

The use of "Hayden," "we," "us," or "our" in these Terms refers to Hayden Eastwood in connection with this Site and does not change the legal responsibilities of the sponsoring broker.

3. No Agency or Representation Created by Site Use

Visiting the Site, searching properties, submitting a form, receiving an automated or preliminary response, downloading a resource, or discussing a property does not by itself create a broker-client, agency, fiduciary, or representation relationship. A representation relationship and its scope, duties, compensation, and duration are established through the agreements required or permitted by Texas law and accepted by the appropriate parties and broker.

Do not send confidential information you expect to be protected by an agency relationship until the relationship and appropriate communication method have been confirmed.

Website access to the Information About Brokerage Services form does not replace any separate delivery or acknowledgment required at the first substantive communication concerning specific real property.

5. Informational and Educational Purpose

Site content is provided for general informational and educational purposes and may not reflect your specific facts or the most recent legal, market, lending, tax, insurance, or property conditions. Nothing on the Site is legal, tax, accounting, lending, insurance, appraisal, engineering, inspection, or financial advice. 6. Property Listings, IDX Data, and Market Information

• Listings, availability, prices, status, square footage, school information, taxes, amenities, and other property data may come from MLS, IDX, public, or third-party sources and may change or contain errors.
• Listing information is provided for consumers' personal, noncommercial use and should be independently verified before making a decision.
• Market commentary, statistics, neighborhood descriptions, comparisons, and projections are snapshots or opinions, not guarantees of present or future value or performance.
• A listing displayed on this Site does not necessarily mean Hayden or JBGoodwin REALTORS® is the listing broker or represents a particular party.

7. Calculators, Estimates, and Downloadable Resources

Mortgage, affordability, BAH, closing-cost, net-proceeds, comparison, and other calculators provide illustrative estimates based on user inputs and general assumptions. Outputs are not quotes, loan approvals, appraisals, settlement statements, tax advice, or guarantees. Actual results depend on property-specific facts, lender requirements, interest rates, taxes, insurance, title, appraisal, inspection, contract terms, fees, and other variables. Verify all material figures with the appropriate professional.

8. Forms, Electronic Communications, and Text Messages

When you submit a form, schedule an appointment, use chat, or otherwise request contact, you authorize us and our service providers to use the information supplied to respond to that request. You are responsible for providing accurate contact information and for having authority to provide any telephone number or email address submitted.

If you expressly opt in to marketing text messages, you consent to receive recurring automated or non-automated marketing messages from Hayden Eastwood regarding real estate services at the number provided. Consent is not a condition of purchasing goods or services. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. You may unsubscribe from marketing email using the link provided in the email.

Electronic communications are not guaranteed to be secure, timely, or error-free. A form submission or email does not satisfy a contractual notice requirement unless the applicable agreement expressly permits that method and receipt is confirmed as required.

9. Fair Housing and Equal Opportunity

10. Third-Party Services and Links

The Site may link to or embed property search, maps, forms, scheduling, chat, reviews, lenders, calculators, social platforms, and other third-party services. We do not control and do not endorse or guarantee third-party content, products, licensing, security, availability, terms, or privacy practices. Your use of a third-party service is governed by that provider's terms. A link or introduction does not guarantee performance or create responsibility for a third party's acts or omissions.

11. Intellectual Property

Unless otherwise stated, the Site's original text, design, graphics, branding, photographs, compilations, and software are owned by or licensed to Hayden Eastwood, JBGoodwin REALTORS®, or their respective licensors and are protected by intellectual property laws. MLS and IDX content remains subject to the rights and rules of its owners and providers.

You may access and print a reasonable amount of Site content for personal, noncommercial real estate research. You may not reproduce, republish, sell, create a competing database from, remove notices from, or commercially exploit Site content without written permission from the applicable rights holder.

12. Acceptable Use

You agree not to:

• Use the Site for an unlawful, fraudulent, discriminatory, harassing, or abusive purpose
• Submit information you know is false, misleading, infringing, or unauthorized
• Impersonate another person or misrepresent your identity, authority, or affiliation
• Attempt to gain unauthorized access to accounts, systems, data, or restricted areas
• Introduce malware or interfere with Site operation, security, or availability
• Scrape, harvest, index, or extract Site or listing data through automated means except as expressly authorized by the applicable data provider and law
• Bypass access controls, rate limits, attribution, or intellectual-property notices

We may restrict or block access when reasonably necessary to protect the Site, its users, data providers, or legal rights.

13. User Submissions and Feedback

You retain ownership of content you submit. You grant us a nonexclusive right to use, store, transmit, and disclose that content as reasonably necessary to respond to your request, operate the Site, provide services, comply with law, and protect rights and safety. Do not submit content you lack authority to share.

If you voluntarily provide general feedback or suggestions about the Site, we may use them without restriction or compensation, provided we do not publicly identify you without permission.

14. Disclaimers and No Warranties

To the fullest extent permitted by law, the Site is provided "as is" and "as available." Hayden Eastwood and JBGoodwin REALTORS® disclaim warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, security, availability, and uninterrupted or error-free operation. We do not warrant that using the Site will result in a transaction, representation agreement, financing approval, property availability, savings, profit, or any particular outcome.

Nothing in these Terms excludes a warranty or duty that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, Hayden Eastwood, JBGoodwin REALTORS®, and their respective owners, personnel, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, opportunity, goodwill, or business arising from or related to the Site, third-party services, or reliance on Site content.

These limitations do not apply to liability that cannot lawfully be limited and do not alter duties arising under a separately executed brokerage agreement or applicable real estate law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hayden Eastwood and JBGoodwin REALTORS® from third-party claims, damages, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or content you submit without sufficient rights or authority. This provision does not require indemnification for a party's own conduct where prohibited by law.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, an action arising solely from these Terms or Site use must be brought in a court of competent jurisdiction in Williamson County, Texas. A separate brokerage or transaction agreement may contain different dispute-resolution terms that govern matters within that agreement.

18. Severability, No Waiver, and Assignment

If a provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without written consent. We may assign these Terms in connection with a lawful transfer of the Site or related business operations.

19. Changes to These Terms

We may update these Terms to reflect changes in law, technology, services, or business practices. The "Last updated" date identifies the latest revision. Updated Terms become effective when posted unless another effective date is stated. Continued Site use after an update constitutes acceptance of the revised Terms.
